These Terms & Conditions apply to your use of mattress.com.au and to any order placed with us. By accessing our website or placing an order, you agree to these Terms & Conditions. Nothing in these terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law.
1. Website Terms
1.1 Website use
This website is provided for general information and shopping purposes. You agree to use it lawfully and not in any way that may interfere with its operation, security or availability.
1.2 Product information
We take reasonable care to ensure that product descriptions, images, specifications, prices and other website content are accurate and up to date. However, errors, omissions or changes may occasionally occur.
1.3 Images and display
Product images are provided for illustration and general indication only. Actual products will vary from what is shown. Colours, finishes, quilting patterns, fabrics, handles, labels, embroidery and other visual or design details may differ from product images, display models or previous versions. Variations may arise from normal manufacturing tolerances, product updates, run-out fabrics, supplier changes, and the removal or simplification of non-essential components or decorative features. Such differences do not of themselves indicate a fault or defect.
1.4 Availability
Products displayed on our website may not always be available for immediate purchase or delivery. Listing a product on our website does not guarantee availability or acceptance of any order.
1.5 Pricing and clerical errors
We reserve the right to correct any pricing, description, image, specification or other clerical error at any time, including after an order has been placed. If an error affects your order, we may contact you with the corrected information and give you the option to proceed or cancel. If we are unable to contact you, we may cancel the affected order and refund any amount paid for that item.
1.6 Intellectual property
All content on this website, including text, graphics, logos, images, layouts and design elements, is owned by or licensed to mattress.com.au and must not be copied, reproduced, republished or used without our prior written consent.
1.7 Third-party links
This website may contain links to third-party websites for convenience only. We are not responsible for the content, availability, security or practices of those websites.
2. Order Terms
2.1 Placing an order
When you place an order, you are making an offer to purchase the selected product or products subject to these Terms & Conditions.
2.2 Order acceptance
An order is not accepted until we confirm it. An automated order receipt or confirmation email does not of itself constitute acceptance of your order. We may decline, place on hold, or cancel an order at our discretion before delivery, including where there is a pricing or description error, stock unavailability, a payment issue, a delivery limitation, suspected misuse or fraud, or any other reasonable issue affecting fulfilment.
2.3 Payment
Orders must be paid for in accordance with the payment options offered at checkout, unless otherwise agreed by us in writing.
2.4 Stock and supply
Some products may be in stock and ready for dispatch, while others may be sourced to order, made to order, or subject to supplier or manufacturing lead times. Any estimate as to availability, dispatch or delivery is indicative only unless we expressly state otherwise.
2.5 Changes to orders
Requests to change an order after it has been placed may not always be possible. Whether a change can be made will depend on the stage of processing, sourcing, manufacture, allocation or dispatch. We may accept or refuse any requested change at our discretion.
2.6 Cancellation by customer
Except as required by law, we do not accept cancellations for change of mind, incorrect choice, preference, size, feel, comfort, support preference or similar reasons. Any request to cancel an order is entirely at our discretion. If we agree to a cancellation, we may deduct any reasonable costs or losses incurred by us as a result, including payment processing fees, administration costs, freight charges, storage costs, restocking costs, supplier charges, markdown losses, or other direct costs arising from the cancellation.
2.7 Cancellation by us
We may cancel an order before delivery where reasonably necessary, including due to supply unavailability, delivery limitations, incorrect pricing, suspected misuse, or circumstances beyond our reasonable control. If we cancel an order before fulfilment, we will refund any amount paid for the affected product unless otherwise permitted by law.
2.8 Title and risk
Title in the goods passes to you once the goods have been paid for in full and delivered. Risk in the goods passes to you upon delivery, collection, or, where applicable, safe placement in accordance with your delivery instructions.
3. Delivery Terms
3.1 Delivery areas
We deliver only to areas serviced by us or our delivery partners. Delivery availability may vary by postcode, state, product type, stock location and service level.
3.2 Delivery estimates
Any delivery timeframe provided by us is an estimate only. While we make reasonable efforts to meet estimated timeframes, delays may occur due to manufacturing, freight scheduling, weather, access issues, supplier delays or other circumstances beyond our reasonable control. A delay does not of itself give rise to a right to cancel, return or refund an order, except as required by law.
3.3 Customer responsibilities
You are responsible for ensuring that the delivery address is accurate, someone authorised is available if required, the delivery site is reasonably accessible and safe, and the product can be moved into the property, room or location intended. This includes checking doorways, stairwells, hallways, lifts, corners, gates and any other access constraints before ordering. We are not responsible if a product cannot be delivered into the property or to the intended location due to access limitations that were not identified in advance. Our delivery team is not required to complete delivery into a property or room were doing so would, in its reasonable opinion, create a risk of injury or damage.
3.4 Failed delivery
If delivery cannot be completed due to incorrect address details, lack of safe or reasonable access, absence of the customer, refusal to accept delivery, inability to safely move the product into the property, or any other issue beyond our control, additional delivery, redelivery, storage or handling fees will apply and may be charged at our discretion.
3.5 Inspection on arrival
You should inspect your order as soon as reasonably possible after delivery and notify us promptly if you believe the goods are damaged, incorrect or incomplete.
3.6 Authority to leave
Where authority to leave is offered and selected, delivery may be completed without a signature. In those circumstances, delivery will be taken to have occurred once the order has been left at the nominated location, and risk passes to you at that time.
3.7 Refusal at delivery
Refusal to accept delivery does not create a right to cancel, return or refund the order except where required by law or otherwise agreed by us in writing.
4. Returns, Refunds and Consumer Guarantees
4.1 Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a repair, replacement, refund or other remedy where required by law.
4.2 No change of mind
Except as required under Australian Consumer Law, we do not offer returns, refunds or exchanges for change of mind, incorrect choice, preference, size, feel, comfort, support preference or similar reasons.
4.3 No comfort guarantee
We do not offer a comfort guarantee, sleep trial, suitability guarantee or similar trial-based return policy.
4.4 Discretionary exceptions
If we choose to approve a return, cancellation, exchange, credit or other exception outside your legal rights, we may do so entirely at our discretion and subject to any conditions we consider appropriate. Any such approval in one instance does not oblige us to do so again.
4.5 Condition of returned goods
Where we agree to accept goods back, the goods must be returned in the condition required by us. Except where return is required by law, we may refuse goods that are used, damaged, marked, soiled, unsanitary, altered, incomplete, or not suitable for resale.
4.6 Costs of approved discretionary returns
Where we approve a discretionary return, exchange or cancellation, we may deduct any reasonable costs incurred by us, including freight, redelivery, storage, handling, merchant fees, restocking costs, markdown losses and supplier charges.

5. Warranty
5.1 Manufacturer warranties
Many products sold by us are covered by a manufacturer’s warranty. Where applicable, the manufacturer’s warranty applies in accordance with the manufacturer’s own terms, conditions and exclusions.
5.2 Our role
Where a manufacturer’s warranty applies, we may assist you with the warranty process, but the warranty itself remains subject to the manufacturer’s terms and assessment.
5.3 ACL rights preserved
Any manufacturer’s warranty is in addition to, and does not replace, your rights under Australian Consumer Law.

6. Core Collection Terms
6.1 General
Core Collection products are our ongoing range of mattresses and related products offered as part of our standard retail assortment.
6.2 Product presentation
Core Collection products may incorporate practical variations or simplifications from other branded or previous-generation models, including differences in fabric, finish, handles, embroidery, labelling, quilting style, or other non-essential design features. These differences do not of themselves indicate a fault or defect.
6.3 Availability and lead times
Core Collection products are newly manufactured to order. Lead times are indicative only unless expressly stated otherwise.
6.4 Product selection
You are responsible for selecting the product, size and comfort preference that suits your needs. Except as required by law, we do not accept returns, exchanges or refunds because a product does not suit your preference in size, feel, comfort or support.
6.5 Product variation
Core Collection products are provided as current production models and will vary from website images, display models and prior versions. Variations may arise from normal manufacturing tolerances, product updates, run-out fabrics, supplier changes, model revisions, and the removal or simplification of non-essential components or decorative features such as handles, labels, embroidery or similar finishing details. These differences do not of themselves indicate a fault or defect.
7. Clearance Item Terms
7.1 General
Clearance items are sold as limited-quantity, clearance, run-out, discontinued, cancelled-order, sample, factory seconds, prototype, or similar stock as described by us from time to time. Clearance items are new and have not been used, we do not sell floor stock or any other items that have been tried, other than manufacturer testing of protypes that may occur from time to time.
7.2 Limited availability
Clearance stock is limited and subject to prior sale. Availability is not guaranteed until your order has been accepted by us.
7.3 Product condition
Clearance items may differ from current standard retail models and may include discontinued finishes, older fabrics, superseded specifications, minor cosmetic imperfections, prior handling, or other characteristics disclosed in the product listing or otherwise communicated by us. Those characteristics do not of themselves indicate a fault or defect where they have been disclosed or are consistent with the nature of clearance stock.
7.4 Clearance returns
Except as required under Australian Consumer Law, clearance items cannot be returned, refunded or exchanged for change of mind, preference, comfort, size, support preference or similar reasons.
7.5 Substitution or refund if unavailable
If a clearance item becomes unavailable before fulfilment, we may cancel that item and provide a refund, store credit, or, where agreed with you, a substitute product.
7.6 Inspection and acknowledgement
By purchasing a clearance item, you acknowledge that clearance products may differ from current full-line retail stock and may carry specific conditions, disclosures or limitations relevant to that item.
8. Other Terms
8.1 General Privacy
Our collection and handling of personal information is governed by our Privacy Policy at /privacy/.
8.2 Changes to these terms
We may update these Terms & Conditions from time to time by publishing the updated version on our website. The version in effect at the time your order is placed will apply to that order.
8.3 Governing law
These Terms & Conditions are governed by the laws of the applicable Australian jurisdiction in which the transaction is taken to occur, together with any applicable Commonwealth laws of Australia.
